                                            JUDGMENT

JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

The appellants are the opposite parties/ Kerala State Housing Board in CC.No.115/10 in the file of CDRF, Idukki.  The Forum has ordered the opposite party/appellant to restrict the default interest to 12%.

          2. It is seen from the pleadings that the appellant is charging interest at 15% on the loan amount and another 15.5% as default                                                              interest for defaulted payments and another 2.5% as penal interest.  The Forum has directed the opposite party to collect the default interest only at 12%.   It is seen from the discussion that the appellant has already charged the opposite parties for the loan amount interest at 15.5% and the amount has been divided in 168 monthly installments.     The loan is provided by the   Kerala State Housing Board.  The total amount of loan is Rs.70,000/-.

3. The contention of the counsel for the appellant is that the above rates are the agreed rates.  We find that  it is extremely inappropriate on the part of the opposite parties  a Government of Kerala undertaking to charge such rates of interest for defaulted payment.   Hence, we find that there is no scope at all for admitting the appeal.  This appeal is dismissed in limine.

Office will forward the copy of this order to the Forum urgently.
