Brief Facts of the case                                                                                                

Complainant had saving bank account in OP bank vide saving account no. 4408000100175152 and also had ATM debit card no. 5126520007984821.

 

On 24/04/2013, complainant used ATM for withdrawing Rs 15,000/-,but he could not receive the amount though same amount was deducted from his account as per transaction slip received by him from ATM. He stated that his bank balance before transaction was Rs 61,538/ and after transaction, the balance was Rs 46,538/, so he made complaint on toll free number on same date vide no 59660127 as marked here as Ex CW1/1.

 

 

Complainant also visited OP bank number of times to get the amount reverted in his account. He also gave a written complaint to OP on dated 15/05/2013 marked here as Ex CW1/2.

 

When he did not get any reply, sent legal notice through speed post on dated 25/06/2013 marked here as Ex CW1/3 and Ex CW1/4. Thereafter, he filed this complaint and claimed reversal of debited amount Rs 15,000/-and penalty of Rs 100/-per day as per RBI guidelines issued to OP bank. He also claimed Rs 50,000/-as compensation for physical harassment and litigation charges.  

 

Notice was served. OP submitted written statement and denied the specific allegation pertaining to failure to get the cash withdrawal. OP submitted details of ATM transaction data obtained from ATM cell which clearly showed as “transaction of amount Rs 15,000/-was successful”. He also withdrew further amount Rs 5000/ from the same ATM and that too was successful. OP also submitted that there was no excess or less amount found in the said ATM from where complainant withdrew the disputed amount as per their internal data. Hence, OP denied any deficiency in their working and any defect in the said ATM.  So, the complaint had no merit and may be dismissed.  

 

Complainant submitted rejoinder with evidence as bank account detail showing deduction of Rs 15,000/-. OP had not submitted their evidence. Arguments were heard from complainant and order was reserved.

 

After going through all the facts and evidence on record, we have observed from the zerox of account detail submitted by complainant which showed that transaction happened for Rs 15,000/- on 24/04/2013 and same was deducted from his account as per Ex CW1/1 which correctly corroborates with internal data record submitted by OP. It was also observed that the complainant had withdrawn another amount of Rs 5000/-just after disputed amount that too was successful.

 

On scrutinizing the accounts detail, it was seen that complainant had withdrawn number of times from the same account and ATM data also reflects that his both transactions were successful. That being so there was no deficiency on the part of OP. Thus, this complaint has no merit and the same disserves to be dismissed, so dismissed without cost.  

 

The copy of the order be sent to the parties as per rules and file be consigned to the record room.
