This appeal has been filed against the judgment of learned

DCF Jaipur 3^rd Jaipur dated 21.11.2014 by which it dismissed the complaint.

 

Brief facts giving rise to this complaint are that the complainant is a pensioner whose pension is credited to her account with the respondent bank. On 8.2.2013 a sum of Rs.48137/- was erroneously credited to her account. The bank came to know of this error and it contacted the complainant on telephone and she was informed that this amount is being debited to her account. Subsequently this amount was debited to the complainant's account. The complainant filed a complaint for deficiency of service but the learned DCF found no deficiency in service.

 

The learned counsel for the appellant has argued that only 1/3^rd of the amount erroneously credited could have been debited on monthly basis from the complainant's account. We do not agree with the contension advanced by the learned counsel as this amount was not recovered under any decree of the court or under any attachment under which only 1/3^rd of the salary or pension could be recovered. If the amount was erroneously credited, the bank had right to recover the same.
