Miscellaneous Proceedings u/s 340 Criminal Procedure Code are initiated against the non-applicant P.K.Wadhwa authorized officer, Central Govt. Employees Welfare Housing Organization and notice was issued. Reply was filed.

Heard the counsel for the non-applicant, perused the explanation as well as documents submitted alongwith the reply.

 

This Commission was of the view that there is no evidence to the effect that the construction was commenced on 21.11.2002 of the impugned project as no documentary evidence was submitted. In reply to the notice the contention of the non-applicant is that tenders were issued for the construction work and execution work was assigned vide letter dated 10.10.2002 and certificate of payment Anx. 2 is submitted which shows that commencement date is 21.11.2002 and completion date is 20.8.2004 and contractor is Mitra Guha Builders to whom communication dated 10.10.2002 was sent. Further Anx. 4 is submitted which shows that to other allottees on 11.11.2002 it was informed that construction at the project has already been commenced. Anx. 3 summary of the project governed by the Central Govt. Employees Welfare Housing Organization is submitted which shows that in Jaipur construction was commenced in November 2002 and completed in October 2005.

Hence, in view of the above no further action is needed and the notice issued to P.K.Wadhwa stands withdrawn.
