COMPLAINT U/S 12 & 13 OF CONSUMER PROECTION ACT

ORDER:-

            In brief, the grievance of the complainant is that she had opened her account vide registration No. U-22173858 with the OP for sage and gain something on her earned money and she deposited Rs. 50,000/- cash in this account/policy in the shape of single installment and the maturity date of this account was fixed 27.08.2015 by the company.    It is alleged that since about more than 3 month  have lapsed to mature the account/policy as well as deposition of bonds etc. to the company for getting the full and final matured value, but till date the OP not paid nothing to her.  The complainant further alleged that due to the act and conduct of the OP she has to suffer harassment mentally, physically and economically. Hence, it amounts to deficiency in service on the part of OP and as such, she has to file the present complaint for matured amount alongwith interest and compensation on account of harassment. 

2.                     OP has failed to come present.  Hence he was proceeded against exparte vide order dated 05.07.2016.

3.                     In order to make out his case, the counsel for complainant has tendered into evidence Annexure C-1 & Annexure C-2 alongwith affidavit Annexure CW1/A.

4.                     We have gone through the record of the case carefully and have heard the counsel for the complainant.

5.                     Learned counsel for the complainant reiterated the contents of the complaint.  He submitted that the complainant deposited Rs. 50,000/-  in cash with OP and a letter dated 30.08.2008 Annexure C-1 was issued by the OP.  At the end of the term on 27.08.2015 the OP has failed to pay the maturity amount to the complainant.  He submitted that the complainant has deposited the form and bond etc. with the company on 20.08.2015 vide receipt Annexure C-2 and the complainant has not received the maturity payment from the OP till date.  We have perused the relevant material on the record.  The OP has not bothered to contest the claim of the complainant and no material has come on the file against the claim of the complainant.  Considering the facts of the case, the complaint of the complainant is allowed and direct the Ops to pay the maturity amount alongwith interest @ 8 per cent per annum till the date of payment to the complainant. Certified copies of the order be sent to the parties free of costs.  File be consigned to the record room, after due compliance.
