Shaji P A filed a consumer case on 28 Dec 2018 against Oxygen Digital Shope in the Idukki Consumer Court. The case no is CC/267/2017 and the judgment uploaded on 08 Mar 2019.
On 19/02/15 the complainant approached the opposite party for purchasing two numbers of I Ball Slider Stellar A2 Tablet phone. At that time the manager of the opposite party said that only one pieces of such a tablet was available there at that time, if the complainant paid price of the other piece, they will deliver it to him within one week. Believing the words of the opposite party, complainant purchased one phone an entrusted an amount of Rs.14,700/- to the opposite party for the price of 2 tablet phone, and in return opposite party given one tablet phone to the complainant for an amount of Rs.7,500/-. After the promised period complainant approached opposite party and demanded the second phone. At that time opposite party said that, the phone is out of stock, and directed him to enquire it with their Kottayam show room. As directed, complainant enquired it with the Kottayam shop of the opposite party, and from there the complainant got information that such type

of Tablet Phone are not available. Immediately after this, the complainant approached the opposite party for getting back the amount which was entrusted by him. But the opposite party failed to repay the amount. In the mean time, the Tablet Phone which the complainant purchased from the opposite party got damaged. When the complainant approached the opposite party for curing the defect of the phone, the opposite party promised that since the phone covers warranty, they will replace it with another one. Believing the words of the opposite party, complainant entrusted the phone to them. But till day the opposite party has not returned the phone even though the complainant approached them so many times. Now the complainant has lost his phone as well as the purchase price of another phone. Till date the opposite party neglected to replace the damage phone as well as the amount which was entrusted to them by the opposite party for delivering another Tablet Phone. Under the above circumstances alleging unfair trade practice against the opposite party, complainant approached the Forum for getting back his phone, and the amount which he was entrusted to the opposite party, along with compensation and cost.
Even though the notices along with the copy of complaint issued from this Forum duly served to the opposite party, opposite party failed to appear before this Forum and contest the matter. Hence opposite party set exparte. Evidence adduced by the complainant by way of documents. The documents such as invoice dated 19/12/15, cash receipt dated 19/12/15, copy of lawyer notice dated 13/05/16 and AD card are marked as Ext.P1 to Ext.P4 respectively.
Heard,
The point that arose for consideration is whether there is any deficiency in service from the part of opposite parties, and if so, for what relief the complainant is entitled to ?
The Point:- We have heard the counsels for the complainant and gone through the evidence on record. On perusing Ext.P1 invoice and Ext.P2 cash receipt the Forum found that the opposite party received Rs.14,500/- from the complainant and from that amount complainant purchased one I Ball Slide Steller A2 Tab on 19/12/15. Balance amount is with the opposite party for delivering another Tablet phone of the same model. The Forum also noted

that before approaching herein complainant demanded the amount which he was given to the opposite party as well as the damaged phone which he was entrust to the opposite party through a lawyer's notice. Even after the receipt of legal notice, opposite party miserably failed to react with it. Here also opposite party has not adduced any evidence to counter the allegation levelled against them by these complaint.
On the basis of above discussion Forum found gross unfair trade practice on the part of the opposite party in this matter. Hence the complaint allowed. Forum direct the opposite party to repay an amount of Rs.7000/- along with 12% interest from 19/12/15 to the complainant. Forum further direct the opposite party to hand over the Tablet Phone already entrusted to them by the opposite party after curing its defect to the satisfaction of the complainant or else by replacing it with a new one, or its purchase amount and further direct the opposite party to pay Rs.5000/- as compensation and Rs.2000/- as litigation cost to the complainant. All the above said direction shall comply within 30 days from the date of receipt of copy of this order, failing which this all amount stated above in different heads shall carry 12% interest per annum from the date of default till the realization.
