This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party. After admitting the complaint notice was issued to the opposite party. After accepting the notice, the opposite party failed to appear before this Commission on the date fixed for appearance or on the subsequent posting dates. Hence on 10/11/2021 this Commission declared the opposite party as ex prate and since 06/12/2021 this case is adjourned only for the purpose of filing ex parte affidavit of the complainant. As the complainant was continuously absent, this Commission issued a notice to the complainant for his appearance before this Commission to further proceed with this case the said notice was accepted by the complainant and not appear before this Commission to further proceed with this complaint. In view of the continuous absence of the complainant and the non-filing of affidavit by the complainant, we find that the complainant is not interested to further proceed with this case. In the above circumstance we find that this is a fit case to be dismissed for default.
In the result the complainant is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
