Both parties file hazira through Advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder.

The Complainant’s case is that he purchased an Electronic Scooty (RACING-ANANT (BLUE)-12V 32 HZ on 07/07/2023 from the O.P. for Rs.60,800/- but after three months’ of purchase the Complainant noticed that the colour portion of the body/chasis of the Scooty started to fade with the undercoat covers visible and the defect was brought to the notice of the O.P. on 07/10/2023 who avoided the same on the ground that there is no warranty or guarantee of colouring of the e-bike. The Complainant has therefore approached this Commission for appropriate relief.

O.P. contested the case by filing a written version contending inter alia that it being a Sub-Dealer has no product liability in this case and that the Complainant could not pay the entire money of the Scooty initially and deducted the cost of colouring of the Scooty after bargaining. The Complainant is not therefore entitled to get any relief in this case.

-: Decision with reasons:-

Having regard to the facts of the case, contention, submission, and documents on both sides the Commission finds that  the colour of the body/chasis of the e-bike is no doubt of low quality and the O.P. being the product seller must take the responsibility for colouration of the body/chasis afresh at its own cost and expenses.     

Hence it is ordered…….

That the case is disposed of on contest by directing the O.P. to arrange original colour coating of the body/chasis of the e-bike in question with fresh materials at its own cost and expenses within a month from this date in default law will take its own course.

Both parties be supplied copy of this Order free of cost.
