            The complainant purchased a Volkswagen car on 30.9.11. It is the case of the complainant that the car had the warranty for 2 years and during the warranty period of 2 years the complainant though faced some problems, but those were rectified. Subsequently with the detention of several defects in the said car the complainant had to bear the expenses for getting service from the authorized service centre. After the lapse of several years particularly warranty period the complainant discovered that the automatic locking system was not functioning properly. Since the locking system if switched off, doors tailgate and tank flab can be locked or unlocked manually if the car key or central locking system fails. On the basis of the said fact the complainant filed this case praying for replacement of the vehicle and compensation of Rs.10 lakhs.

            It appears from the materials on record that the car was purchased about 6 years ago and the complainant during the warranty period availed of all the facilities provided to the car owner. After the lapse of several years and after running of the car for several thousands kms. and the complainant filed the documents that he went to service centre for repairing of the car upto the month of Nov. 2013 and thereafter the claim made by the complainant as regards the non functioning of the locking system, no such document has been filed from any service centre to corroborate the said allegation against the manufacturer of the said car. In view of the said fact the case filed by the complainant has got no merit and the same is dismissed in limini.

            Hence, ordered,

            That the case no. CC/379/2017 is dismissed in limini.
