1.                         The brief history of case of the complainant is that he had taken Cable connection from the OP to his house at Dasarathi Street on 20.09.2016 on payment of Rs.1225/- vide Receipt No.506628 towards Security Deposit.  It is submitted that he had paid one month subscription to the OP for usage period and due to his transfer from Jeypore he has surrendered the facilities to the OP on 20.10.2016 and requested the OP to refund the security deposit amount of Rs.1225/- but in spite of request the OP is not refunding the amount.  Thus alleging unfair trade practice on the part of the OP, he filed this case praying the Forum to direct the OP to refund Rs.1225/- with interest and to pay Rs.10, 000/- towards compensation and cost to the complainant.

2.                         In spite of valid notice the OP did not prefer to contest the case in any manner.  No counter is filed by the OP.  Hence this case is to be decided on merit.  The complainant has filed certain documents in support of his case.

3.                         In this case the complainant has taken cable connection from the OP on 20.09.2016 as ascertained from the money receipt granted by the OP.  Vide Money Receipt No.506628; the OP has also received the SD amount of Rs.1225/- as found from the record.  The complainant has surrendered the facility on 22.10.2016 as ascertained from the required disconnection form of the OP dully filled in and the OP has acknowledged the same

4.                         The case of the complainant is that in spite of his repeated request for refund of SD amount, the OP has not taken any step.  Naturally, after surrender of facilities, the OP is duty bound to refund the SD amount in due time but no action is taken by the OP in this case.  In absence of counter and participation of OP in this case, we lost opportunity to know anything more from the OP about this case.  Hence the allegation of the complainant remained unchallenged.  In the above circumstances, we are of the view that the complainant is entitled to receive back the SD amount of Rs.1225/- from the OP from 22.10.2016 with interest @ 12% p.a.  Due to such inaction of the OP, the complainant must have suffered some mental agony and on this score, the complainant is entitled for some compensation.  Considering the sufferings of the complainant we feel a sum of Rs.2000/- towards compensation and cost in favour of the complainant will meet the ends of justice.

5.                         Hence ordered that the complaint petition is allowed in part and the OP is directed to refund Rs.1225/- towards SD amount with interest @ 12% p.a. from 22.10.2016 and to pay Rs.2000/- towards compensation and cost to the complainant within 30 days from the date of communication of this order.
