This  is   an   order   arising   out  of  a   condonation   of  delay   petition   filed   by the   complainant  /   petitioner   who    have   filed a    complaint    case  no-   23/23   under   section-35    of   C.P.Act, 2019   . The   cause   of  action   arose   in  the   matter   of     27/1/21    &    complaint  case   was   filed   on  21/3/23   whereby   it  is  submitted   that   there   is  a  delay   of  35   days     in  filing   the   complaint  case.   To the  above   petition  the       opp.  party   raised   objection    stating   that   complainant   with  a   malafide   intention   &   to   harass   the   opp.party   filed  this  claim   after  full  &   final   settlement   &   further   submits  that  question   does  not    arrive   at  all   about  repudiation  after  full  &   final  settlement    . The   opp.  party    denies   the   contention   made  in  the   application   submitting     that  the    complainant     negligently    and     deliberately  filed   the  case   with a     condonation   petition      &   is   liable   to  be   dismissed.   Many   questions   has  been      raised   in the   objection  petition, but  we   have    concentrate  upon   the   fact   that    delay   was   caused   owing  to  the  fact       that   petitioner   went  to   take   care  of  mother-in-law   , who  is   old  aged   &    ailing  &   has  undergone   eye    operation.   According  to the   complainant   owing  to  the    health   condition   of  the   mother-in-law  of  the   petitioner     she was  not  in  a   position   to  file    the   complaint   petition  at    the   relevant   time.  Copies   of  rail  tickets   &  medical   documents  of  the   mother-in-law     of the   petitioner  has    been  submitted  with the   petition  &   after   going   through  all  the   documents  , we   are  of   the  view  that    ground  stated  in the   condonation  of  delay   petition for     only  35   days   is  satisfactory   &    justified.  Hence  ,     condonation  of  delay   petition  is  allowed.   Misc. Case  is   disposed. The  original     case  filed  by the  complainant  be   put  up    for  hearing.
