ORDER

 

SRI.P.V.JAYARAJAN: PRESIDENT

This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  After admitting the complaint, notice was issued to the opposite party.  The opposite party entered appearance and filed written version denying the allegations raised by the complainant.  The grievance of the complainant was that he has incurred an expenses of Rs.1,30,000/- for repairing the vehicle which is having valid insurance coverage with opposite party.  According to the complainant the opposite party was not ready to settle the claim made by him.  When the case came up for consideration on 04/03/2023, both parties represented to refer the matter for mediation.  Hence the matter was referred to mediation to be held on today i.e., 18/03/2023.  The matter was discussed and settled for an amount of Rs.70,000/-.  The compromise memo signed by both parties and their respective counsel was also filed before this Commission.  Above referred compromise memo is accepted and recorded.  In view of the settlement arrived at between the parties to the proceedings, we find that this is a fit case to be allowed in terms of compromise memo. 

                        In the result complaint is allowed in terms of compromise memo dated 18/03/2023.  The compromise memo dated 18/03/2023 will form part of this Order.

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.

Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the Open Court, this the 18th day of March,  2023.
