CC No.115 of 2021.

Baljeet Singh Versus UHBVN.

 

Present:         None for the complainant.

                      None for the respondents.

                       

                Complaint was instituted on 09.03.2021 and thereafter, complainant failed to appear before the Commission, such as, on 05.04.2021 & 09.08.2021. As per order dated 12.03.2021, notice of complaint was ordered against respondent, but the registered post received undelivered, due to incorrect address of the respondent. Vide orders dated 05.04.2021 and 09.08.2021, an opportunity was given to the complainant to furnish correct address of the respondent and place on record registered post envelope. Neither he himself appeared nor compliance of orders of this Commission has been done. It means, complainant is no more willing to prosecute the complaint any further and in the absence of complainant, this Commission cannot proceed ahead against the respondent, in the eventuality, its whereabouts are not known, complaint cannot be decided on merits. The Commission is sitting regularly and doing physical hearing w.e.f. 1^st July, 2021 onwards. The complaint is dismissed for want of prosecution. However, complainant shall be at liberty to file afresh complaint against the respondent on the same cause of action on furnishing correct address of respondent and fresh complaint shall be subject to period of limitation. File be consigned to the records.
