                   Today case was fixed today for arguments.  However, none has put appearance on behalf of appellant.  Perusal of case file reveals that: lastly on 23.01.2020, Sh. Varun Sharma-Advocate had appeared on behalf of appellant. Thereafter, on all subsequent dates fixed in this appeal; he has/had not appeared. Period of more than four years has passed as on today. Due to absence of counsel for appellant, even on one date (10.08.2020); this Commission has observed “it might be constrained to dismiss the appeal in default”. This appeal is of year 2018. It cannot be allowed to linger on for causing appearance of counsel for the appellant.  This Commission does not find any justification to adjourn this appeal to any further date for arguments in view of above glaring situation so visible in appeal file.  Today also appeal has been called several times since morning. It is already 12:50 P.M. No further wait is justified. It appears that appellant is no more interested to pursue this appeal in order to take it to its logical end. Hence, present appeal is hereby dismissed, not only in default owing to absence of counsel for appellant, but also for its non-prosecution. It is ordered accordingly. Appeal file be consigned to record room.
