Heard learned counsel for both sides. During course of arguement it appears that as per the surveyor report the amount of Rs.4,22,745/- has already settled but the complainant did not receive the amount. Today the complainant agreed to receive the money. As per the impugned order, the money has not paid which is deficiency in service on the part of the O.P. Since the complainant agreed to accept the amount as per the surveyor’s report, we hereby set aside the impugned order by allowing the appeal direct the O.P. to pay Rs.4,22,745/- to the complainant within a period of 45 days, failing which it will carry interest at the rate of 9%  per anum from the date of impugned order till payment is made.
