  2. Medi Assist India TPA Private Limited, through its Branch Manager, 1st Floor, Plot No.7, Excom House, North Wing, Sakivihar Road, Saki Naka, Andheri, East Mumbai.

Complaint under Section 12 of Consumer Protection Act, 1986.

Present: Shri S.S.Moonak, counsel for the complainant.

Shri Dinesh Kumar, Assistant Manager on behalf of the OIC alongwith Sh. Naveen Khetarpal Advocate for OP-1.

                 

                File taken up today on the application filed by learned counsel for the both parties with permission to withdraw the complaint.

                 Learned counsel for the OP-1 has suffered a separate statement to the effect that matter has been compromised between the parties and as per the compromise, OP-1 is ready to pay Rs.35,000/  to the complainant, as full and final settlement, within 30 days.

                On the other hand, learned counsel for the complainant also suffered his separate a statement to the effect that the matter has been compromised with the OP-1 and he does not want to pursue the present complaint and withdraw the same.

               In view of statement of the learned counsel for both parties, the present complaint is hereby dismissed as withdrawn being compromised. Both the parties would be governed by the statement made by their respective counsels. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
