7)            Exh.‘C’alongwith the affidavit of Complainant No.1 dtd.05/07/2013 i.e. the terms and conditions of Overseas Mediclaim Insurance in which under the head “covered expenses” - expenses for medical evacuation, including transportation are shown covered. In the said terms and conditions under the head “Section G- trip cancellation/curtailment” sudden sickness of insured’s spouse, child or parents residing with him/her in India is also shown would be indemnified by the Opposite Party.  thth    the result we pass the following order –

O R D E R

i.               Complaint No.15/2011 is partly allowed against the Opposite Parties.

ii.              The Opposite Party No.1 & 2 are directed to pay jointly and/or severally an amount of Rs.4,96,222/-(Rs. Four Lacs Ninety Six Thousand Two Hundred Twenty Two Only) to the Complainants alongwith interest @ 6% p.a. from 19/08/2010 till its actual payment and Rs.20,000/- (Rs. Twenty Thousand Only) as compensation to them for the mental agony and torture suffered by them and cost of Rs.5,000/- (Rs. Five Thousand only).

iii.          The Opposite Party No.1 & 2 are directed to comply the aforesaid order within one month from the date of receipt of this order.

iv.          Certified copies of this order be furnished to the parties.
