Shri BHASKAR B. YOGI, PRESIDENT.

1. The complainant has earlier filed one Consumer complaint bearing No. 107/2011 which was decided by this forum on dated 07/02/2012 (Copy of Judgment filed by opposite party along with written version) we perused the judgment and this is confirmed that the death claim of Late Ashish S/o Dhanlal Daji Ramteke, which is also subject matter in the present complaint (Document No. 2 page no. 17) of Complainant compilation.

2. Thus for cause of action second complaint is filed inspite of earlier complaint decided on merit.

3. This is serious fraud upon forum/court and also misuse & abuse of law.      

                          Hence, the following order.

                                   ORDER

1. The Complaint CC/18/83 is Dismissed u/s 26 of CPA, 1986 with cost of Rs. 2,000/- to be paid to the Opposite Party and Rs. 2,000/- be deposited in Legal Aid Fund.

2. Copy of the order be furnished both the parties free of cost.
