ORDER
30/04/2009 Com.No.2241/2008 The learned Advocate for the opposite party filed a memo stating that vehicle No. KA-02/D-2029 was insured with the opposite party No.1 insurance company at Chennai for the period from 06/08/2007 to 07/06/2008 and vehicle is hypothecated with M/s Shriram Transport Finance Company Ltd.,. A letter was addressed to the complainant to submit documents for settling the claim. Though opposite party No.2 had received few documents in order to process the claim the complainant had to submit the documents for verification of the same as per letter dated 25/11/2008. Claim has to be settled in favour of the financer. Under the circumstances, it is submitted that the Honble Forum may be pleased to direct the complainant to submit the documents as per letter dated 25/11/2008 to the office of the company at Regional Office, Oriental Insurance Company Ltd., Leo Shopping Complex, 44/45, Residency Road, Bangalore who in turn would forward same to the issuing office for further consideration and the settlement of the claim of the complainant. Therefore, in view of this memo there is absolutely no dispute between the parties. It is clear that the claim put up by the complainant is not been repudiated by the opposite parties. The claim put up by the complainant is still pending before the opposite parties. The learned Advocate for the opposite party has also produced copy of order passed in Complaint No.2242/2008 by this Forum and in that complaint also the complainant was directed to submit all the required documents to the Regional Office for settling the claim. The opposite party in view of that direction had settled the claim for Rs.33,000/- in favour of the Financer after obtaining No Objection Certificate from the complainant. The present matter also requires to be disposed off in the similar line or manner. In the result, it is quite jut, fair and reasonable to dispose off the matter with the following:- ORDER 2. The complainant is directed to submit all the required documents to the Regional Office, LEO Shopping Center, 44/45, Residency Road, Bangalore 25 for settling the claim. The opposite parties are directed to settle the claim of the complainant within 45 days with intimation to this Forum. In view of the above direction the present complaint is closed and disposed off. 3 Send the copy of this Order to both the parties free of costs immediately as a statutory requirement. 4.
