Complainant/petitioner got his truck insured with the respondent – insurance company for a sum of Rs.13 lakh which was valid from 29.11.2006 to 28.11.2007.  The said vehicle was stolen on 9.11.2007.  FIR was lodged with the police but no intimation was given to the insurance company.  Insurance company was intimated about theft of the vehicle in question after seven months of the theft.  The claim was not entertained by the insurance company. 

Aggrieved by this, the petitioner filed a complaint before the District Forum. 

District Forum dismissed the complaint. 

Aggrieved with the order of the District Forum, the petitioner filed an appeal before the State Commission, which has dismissed the appeal relying upon the judgment of this Commission in the case of Devendra Singh Vs. National Insurance Company Ltd., reported in 2004 (1) Judicial Reports Consumer, 92 in which it has been held that the delayed intimation to the insurance company deprives the insurance company to investigate the matter under the terms of the policy.  The petitioner is supposed to inform the insurance company immediately after the occurrence of any damage or theft of vehicle under the terms of the policy.  

We agree with the view taken by the State Commission.  Dismissed.
