Though under the policy if the death is accidental i.e., Motor Vehicle Accident, snake bite, drowning in water or fire incident, the nominee is entitled to the insurance amount and even it is held by our Hon’ble State Commission and Hon’ble National Commission that the production of post mortem report and police report about the death by snake bite or drowning in water are not mandatory, because the villagers usually will not report the matter to the police and they will not subject the dead body to post mortem, but in the present case, the very death by snake bite is not proved and Opposite party has repudiated the claim and copy of the letter dated 08.09.2008 is produced by the Opposite party. We cannot blindly award the insurance claim as it is a public money and only in deserving case claim has to be allowed. Therefore, we have to hold that the Opposite party has not committed any deficiency in service in rejecting the claim of the complainant and the complainant is not entitled to the insurance amount or any compensation. <br /> 11. In the result, we proceed to pass the following order;<br /> ORDER<br /> The complaint is dismissed.
