Final Order / Judgement

This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

During preliminary hearing, counsel for the complainant has argued that the complainant was having mediclaim policy bearing No.233200/48/2023/32 in which his spouse Smt.Maya Devi Goyal and complainant were covered. The wife of the complainant was hospitalized in the hospital and an amount of Rs.1,65,410/- was incurred on her treatment. The complainant has intimated the same to opposite parties, but they have failed to settle the claim till date. Due to this, the complainant has suffered from harassment and mental agony.

We have heard learned counsel for the complainant and gone through the record.

A perusal of file shows that complainant lodged insurance claim with opposite parties but they have neither repudiated nor approved the claim of the complainant till date despite availing sufficient time. Therefore, this Commission is of the view that complaint is pre-mature at this stage. As such, without going into merits of the case, opposite parties are directed to decide the fate of the claim of the complainant within 30 days from the date of receipt of copy of this order. As such, this complaint stands disposed off.

In case of non-compliance of the order within the stipulated period, thereafter opposite parties shall be liable to pay cost of Rs.15,000/- to the complainant.

Copy of order be issued to parties free of cost and file be consigned to record room.
