This order shall dispose of present complaint after affording preliminary hearing to the counsel for the complainant.

During preliminary hearing, counsel for the complainant has argued that his insured vehicle bearing No.PB-03AY-3655 met with an accident on 31.8.2021. The complainant have intimated the same to opposite party, but they have failed to settle the claim till date. The complainant has suffered from harassment, botheration and agony.

We have heard learned counsel for the complainant and gone through the record.

A perusal of file shows that complainant lodged insurance claim with the opposite party but opposite party has neither repudiated nor approved the claim of the complainant till date. Therefore, this Commission is of the view that complaint is pre-mature at this stage. As such, without going into merits of the case, opposite party is directed to decide the fate of the claim of the complainant within 30 days from the date of receipt of copy of this order. As such, this complaint stands disposed off.

In case of non-compliance of the order within the stipulated period, thereafter opposite party shall be liable to pay cost of Rs.20,000/- to the complainant.

Copy of order be issued to parties free of cost and file be consigned to record room.
