Sh.B.K.Malik, Proprietor of M/s Malik Jewellers (complainant).

ORDER

 

1.         This order will dispose of the application filed by OPs for compliance of order dated 14.6.2012 and refund of excess amount of Rs.4690/-. Counsel for OPs has made the following statement:-

 

“I have no objection if out of the amount deposited by OPs with this Forum, a sum of Rs.5000/- is released in favour of complainant.

The complainant shall also be at liberty to withdraw a sum of Rs.25,000/- deposited by the OPs at the time of filing the appeal before the Hon’ble State Commission, U.T. Chandigarh.”

 

2.         Sh.B.K.Malik, Proprietor of complainant has made the following statement;-

“I have gone through the above statement made by counsel for OPs. I accept the same.”

 

3.         It is pertinent to mention here that at the time of filing of appeal, the OPs have deposited a sum of Rs.25,000/- before the Hon’ble State Commission, U.T. Chandigarh, and in compliance of the order passed by the Hon’ble State Commission, U.T. Chandigarh, a sum of Rs.9690/- was deposited before this Forum. As per the order dated 14.6.2012 passed by this Forum, the complainant is entitled to sum of Rs.30,000/-. In these circumstances, out of Rs.9690/- deposited by OPs with this Forum, a sum of Rs.5000/- alongwith proportionate interest accrued thereon be released in favour of complainant and remaining amount be released in favour of OP alongwith proportionate interest accrued thereon. The complainant shall be at liberty to withdraw the amount deposited by OPs with the Hon’ble State Consumer Disputes Redressal Commission, U.T. Chandigarh, in accordance with law.

4.         The parties shall be bound by the statement made before this Forum.

5.         Certified copy of this order be communicated to the parties free of cost.  After compliance file be consigned.
