JUDGMENT

JUSTICE SRI.K.R.UDAYABHANU  :PRESIDENT

          The appellant is the complainant in CC.185/08 in the file of CDRF, Kottayam. 

          2. The matter relates to the claim regarding repair cost of the motor cycle involved and covered by the policy of the 1st and 2nd opposite parties/insurer.  The insured had proposed to pay a sum of Rs.17750/- the amount as suggested by the Surveyor.  The complainant had claimed enhanced amount of repair cost which is estimated at Rs.25618/-.  At the time of hearing of the appeal the appellant/complainant has agreed to receive the amount as proposed by the insured ie, opposite parties 1 and 2.  Hence the appeal is disposed of directing opposite parties  1 and 2/insurer to pay a sum of Rs.17750/- to the complainant.  The amount is to be paid within one month from the date of receipt of this order failing which the opposite parties 1 and 2 would be liable to pay interest at 12% per annum from the date of this order ie.25.11.2010.

          Office will forward the LCR along with the copy of this order to the Forum urgently.
