Complainant has filed the present revision petition with a delay of 385 days.  In the application for condonation of delay, petitioner has stated that he was advised bed rest because of which he could not file the revision petition in time.  Medical Certificate in support thereof has not been filed.  The delay of 385 days is enormous and it cannot be condoned without showing sufficient cause which the petitioner has failed to show.  Dismissed on the ground of ‘Delay’.

This apart, the District Forum had allowed the complaint and directed the respondent to pay a sum of Rs.4,00,000/- (Rupees Four Lacs) with interest @ 12% p.a. from 24.1.1999 till realization.  Against the order passed by the District Forum, respondent filed an appeal before the State Commission which has been disposed of by reducing rate of interest from 12% to 9%.  Present revision petition has been filed seeking enhancement of interest to 12% as had been granted by the District Forum.  Prevailing rate of interest in the Banks is less than 9%.  Otherwise also, this is a matter of discretion.  Dismissed on ‘Merit’ also.
