3.         Oriental Insurance Co. through its Incharge, Extension Counter, Opp. Marhi (Peer), above Pankaj Motor, Ropar Road, Kurali, District Ropar.

                                                            ORDER

1.                     Counsel for OP No.1 & 3 has made offer as per the statement given below:

“Statement of Sh.Vinod Chaudhri, Advocate for OP No.1 & 3.

I have been authorized to appear and make the following statement on behalf of OP No.1 & 3 Insurance Company.

The OP Insurnace Company has no objection if the complainant withdraws the amount from the Hon’ble State Commission deposited by OP Ins. Co. at the time of filing the appeal No.601/2009 and the amount deposited before this Forum in compliance of the order of the Hon’ble State Commission at the time of granting the stay is released to the complainant.”

2.                     The complainant has accepted the offer as per the following statement:-

“Statement of Sh.Devinder Singh Sethi s/o Sh.R.S.Sethi, Complainant in person, R/o H.No.1655, Sec.33-D,Chandigarh.

I have gone through the statement made by Sh.Vinod Chaudhri, Advocate for OP No.1 & 3 Ins.Co. and accepted it as correct. Except the payment lying deposited before the Hon’ble  State Commisison and District Forum, the remaining payment has already been made by the OP Ins. Co. However, I withdraw my execution application at this stage. I will take steps to transfer of ownership in favor of insurer” 

3.                     The respective parties shall remain bound by their statements.

4.                     Keeping in view the above, since the complainant has withdrawn the present execution application application, the same is allowed and the present execution application is dismissed as withdrawn. Further, the complainant is allowed to withdraw the amount from the Hon’ble State Commission which was earlier deposited by the OP Insurance Company at the time of filing the appeal No.601 of 2009.

5.                     The amount deposited before this Forum be released to the complainant against proper receipt.

6.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
