Learned Counsel for the Respondent submitted that fresh address of Petitioner could not be ascertained as Petitioner had left the country. Learned Counsel for the Respondent has also drawn my attention towards the affidavit of complainant dated 10.10.2011 given by the Petitioner to the Bank. Perusal of no. of order sheets reveals that notices issued to Petitioner have been received back with postal remarks “out of country”. In such circumstances, it can very well be presumed that Petitioner has left the country and none appearing before this Commission since long. Heard Learned Counsel for Respondent and perused record. Perusal of record reveals that Complainant filed complaint for release of payment of one FDR No. 072609 – 6/02 dated 13.8.2002 for Rs. 1.00 lakh. Opposite Party contested and submitted that payment of this amount has already been made to depositor’s brother Onkar Singh. It appears from the record that complainant’s husband-Sakandar Singh Vaid had deposited amount with opposite party- Respondent, out of which this FDR of Rs. 1.00 lakh was prepared. Learned District Forum dismissed the complaint. Appeal filed by Complainant was also dismissed by Learned State Commission vide impugned order. Affidavit submitted by the Petitioner reveals that she has cancelled special power of attorney in favour of Kuldip Raj Kaila and further stated that now there is no dispute with the Bank and she is quite satisfied with the behavior and services of the Bank. I also do not find any illegality, irregularity or jurisdictional error in the impugned order and in such circumstances, Revision Petition is liable to be dismissed. Consequently, Revision Petition filed by the Petitioner is dismissed with no order as to costs. |
