Heard Sri S. M. Bajpai, learned Counsel for the appellant.

The instant appeal is filed by the appellant Punjab National Bank, Branch Palika Bazar, District Shamli, Through its Branch Manager.

The submission of the learned Counsel for the appellant is that  Complaint Case No. 9/2020 has been filed by the respondent Omveer Singh Tanwar before the District Consumer Commission, Shamli which has been finally heard and decided by the judgment and order dated 14-09-2021.

Vide judgment and order dated 14-09-2021 after considering the material and submission of respective parties the learned District Consumer Commission has ordered as follows:-

“विपक्षी सं0 1 परिवादी की मेडीक्लेम पाॅलिसी की धनराशि अंकन- 1,99,610/-रू0 परिवादी के अस्पताल में भर्ती होने की सूचना मिलने के बाद से

दिनांक-27.09.2019 से 09 प्रतिशत वार्षिक ब्याज दर से  तथा परिवादी को हुई आर्थिक, मानसिक व शारीरिक क्षतिपूर्ति हेतु अंकन- 15,000/-रू0 तथा वाद व्यय हेतु अंकन-3,000/-रू0 परिवादी को भुगतान हेतु निर्णय की तिथि से 30 दिन अन्दर जिला उपभोक्ता विवाद प्रतितोष आयोग शामली में जमा करेगा तथा विपक्षी सं0 1 व 2 द्वारा अनुचित व्यापार व्यवहार अपनाने हेतु दण्ड स्वरूप अंकन-20,000/-रू0 संयुक्त रूप से निर्णय की तिथि से 30 दिन के अन्दर जिला उपभोक्ता विवाद प्रतितोष आयोग शामली के खाते में जमा करेंगे। दण्ड की यह धनराशि परिवादी को देय नही होगी। चूक होने पर दण्ड की धनराशि  छोड़कर देय समस्त धनराशि पर 12 प्रतिशत दण्डात्मक ब्याज निर्णय की दिनांक के 30 दिन के उपरान्त भुगतान की तिथि तक विपक्षी सं0 1 द्वारा देय होगा तथा दण्ड की धनराशि पर 12 प्रतिशत वार्षिक ब्याज विपक्षी सं0 1 व 2 द्वारा संयुक्त रूप से देय होगा। पत्रावली कालावधि पश्चात् दाखिल दफ्तर हो।“

 

The submission of the learned Counsel for the appellant bank is that even in the judgment there is no finding recorded against the appellant, however, in the operative portion of the judgment i.e. the order the District Consumer Commission has imposed a cost of Rs.20,000/- jointly against the opposite party Nos. 01 and 02. The opposite party No.02 before the District Consumer Commission is the present appellant.

We find substance in the submission of the learned Counsel for the appellant and we also find that in the judgment no finding is recorded against the present appellant, the bank who was the opposite party No.02 in the proceedings before the District Consumer Commission.

In view of the aforesaid, we deem it appropriate to cancel the the imposition of penalty upon the present appellant as directed by the learned District Consumer Commission vide judgment and order dated 14-09-2021. Since the Insurance Company is not before us, we deem it appropriate not to comment upon the other finding recorded by the District Consumer Commission.

With the above direction the instant appeal is finally disposed of.
