Counsel for OP2 to OP5 submits that in view of the fact that CE has also been closed & there is no evidence of complainant on record & therefore OP2 to OP5 also close their evidence. Evidence of OP2 to OP5 is also closed.

The Commission has perused the record. It is settled principle of law that pleadings howsoever strong may be, cannot be take place of proof.  Initial onus to proof the deficiency if any was upon the complainant and since the complainant has not filed any evidence it has failed to prove contents of the complaint as filed under provision of Consumer Protection Act. Therefore in absence of any evidence, matter is not required to be decided on merits and suffice is to say that complainant has not placed any evidence in support of his contention and accordingly the complaint has filed is to prove its case by way of evidence. Accordingly complaint is dismissed forthwith. No order as to cost.
