Today the case is fixed for disposal of the appeal in National Lok Adalat.
Learned counsel Sh. S.M. Joshi for the appellant has stated that the entire decretal amount has been paid by respondent No. 2 to the respondent No. 1. Hence, no outstanding amount is payable to respondent No. 1 – complainant. Hence, the appeal be decided as infructuous.
Neither the learned counsel for respondent No. 1 has objected the payment as alleged by the appellant, nor respondent No. 1 – complainant, as the entire decretal amount has been paid.
Thus, the appeal has become infructuous, hence, it be dismissed.
The statutory amount deposited by the appellant before the State Commission or the District Commission be released in favour of the appellant, as per law. So the appeal is accordingly decided. No order as to costs.
A copy of the order be sent to the concerned District Commission for perusal and necessary compliance.
File be consigned to the record room alongwith the copy of the order.
