This consumer complaint has been filed by the complainant against the opposite parties with a prayer that the opposite parties be directed to pay an amount of Rs. 13,82,652/- to the complainant along with interest @12% p.a. and Rs. 2,00,000/- towards compensation for mental and physical agony.

The consumer complaint has been contested by the opposite parties.

In Lok Adalat, the parties have arrived at a compromise.  Complainant – Sh. Vaibhav Bhardwaj is present in person, who has been identified by Sh. N.K. Sarin, learned counsel for the complainant.  On behalf of the opposite parties, Sh. Deepak Ahluwalia, Advocate is present and he has also signed the compromise application.

The compromise application has been filed by the parties, stating therein that the opposite parties have agreed to pay a sum of Rs. 13,83,652/- to the complainant along with interest @9% p.a. from the date of deposit till the date of payment, within a period of 30 days’ from the date of the order and the complainant has agreed to accept the said amount in full and final settlement of his claim and the complainant shall submit the allotment letter and receipt with the opposite parties within a period of 7 days’ from today.

The consumer complaint is, thus, disposed of in terms of the compromise arrived between the parties.  The compromise application shall form part of the order.  It is directed that the complainant shall submit the allotment letter and receipt duly discharged with this Commission within a period of 7 days’ from today and thereafter within a period of three weeks’, the opposite parties shall deposit a sum of Rs. 13,83,652/- together with simple interest @9% p.a. from the date of deposit till payment before this Commission vide demand draft in the name of the complainant.  The allotment letter and receipt be handed over to the opposite parties after deposit of the demand draft by the opposite parties in the name of the complainant.  On deposit of the demand draft, the same shall be handed over to the complainant.
