Compalinant booked for aChappathi Maker of opposite party from the exhibition stall conducted by Malayala Manorama & Silver storm by paying Rs.200/- towards advance payment. Opposite party assured to deliver the product with in 15 days. But opposite party failed to deliver the chappathi maker to the complainant. Hence the complaint.
Complaint posted for hearing on admission . Heard complainant. On verification it is seen that opposite party does not carry business with in the jurisdiction of the forum. No cause of action arisen with in the jurisdiction of the forum. Hence as per Sec 11 of the Consumer Protection Act, complaint is not maintainable before the forum.
In the result , without going in to the merits of the case, we dismiss the complaint with a direction to approach appropriate forum for relief.
