Complainant/petitioner kept 137 bags of potatoes each bag having capacity of 80 kg in the cold storage of the respondents.  It was alleged that due to the negligence of the respondents, the potatoes lost its value due to deterioration and inaction on the part of the petitioner.  Thus, being aggrieved complainant filed the complaint before the District Forum.

-2-

District Forum allowed the complaint and directed the respondents to pay a compensation of Rs.41,000/- to the complainant along with interest @ 10%.  Rs.1,000/- were awarded as costs.

Respondent being aggrieved filed an appeal before the State Commission.  The State Commission by the impugned order has reduced the amount of compensation to Rs.30,000/- and the rate of interest from 10% to 6%.

LRs of respondent no.2 are not present despite service.

We have gone through the order passed by the District Forum and the State Commission.  The State Commission, in our view, has rightly reduced the compensation of Rs.30,000/- and the rate of interest from 10% to 6%.  No ground for interference in the impugned order is made out.  Dismissed.
