This appeal has been filed against the judgment of the learned DCF, Bhilwara dated 22.2.2016 whereby the claim has been allowed against the appellant.

The matter has come upon application u/s 5 of the Limitation Act as the appeal has been filed after 28 days of delay. Looking to the facts mentioned in the application the delay is condoned.

 

Heard the counsel for the appellant on merit also and perused the impugned judgment .

 

The case of the complainant was that he is a regular commuter from Bhilwara to Baneda and also holder of monthly pass. Inspite of the clear directions he was forced to get down from the bus at Baneda bypass petrol pump on 17.4.2014 and it is deficiency of service on the part of the appellant. The appellant has denied the fact but the Forum below after scanning the evidence allowed the claim against the appellant. Hence, this appeal.

 

The contention of the appellant is that the consumer was dropped at Baneda bus stand and complaint is forged one but there is no reason to held so when particularly the Chief Manager,Bhilwara and District Collector, Bhilwara has issued specific direction to ply the bus through Baneda bus stand inspite of this the consumer was forced to get down at Baneda

bypass petrol pump. There is no reason to disbelieve the contention of the complainant and in view of the above, the Forum below has rightly allowed the complaint. There is no merit in this appeal. It is not worth admission and liable to be rejected.
