Heard learned counsel for the petitioner.

2.      Learned counsel for the petitioner submitted that he filed appeal before State Commission on 19-11-2013 and it was to be listed on 24-09-2014 but before this he filed application for early hearing on 5^th January, 2014 and by order dated 31-01-2014 application was to be listed for 04-07-2014 but by impugned order instead of dismissing application, dismissed appeal which may be restored.

3.      Perusal of cause list taken from Website reveals that petitioner’s case is listed for 24-09-2014 and it appears that by mistake instead of dismissing application for early hearing, appeal itself was dismissed vide impugned order dated 04-07-2014.  As this order has been passed by inadvertence, revision petition is to be allowed and impugned order is to be set aside.

4.      Consequently, revision petition filed by the petitioner is allowed and impugned order dated 04-07-2014 passed by learned State Commission in First Appeal No. 1222/13 – Axis Bank Ltd. Vs. Om Jewellers is set aside and appeal is restored to be listed on 24.09.2014.

5.      Petitioner is directed to appear before State Commission on 24.09.2014.
