Mr. Bisweswar Dawn, husband of Smt. Sandhya Dawn (Respondent in Revision Petition No.2466 of 2016) and Ms. Olivia Dan -3- (Respondent in Revision Petition No.2467 of 2016) are present in person and state that they are willing to accept the amounts, deposited by them with the Petitioners along with the interest @ 12% p.a. from the date of each deposit, in addition to the travel and allied expenses, which have already been directed, in full and final settlement of the dispute with the Petitioners, which were the subject matter of the Complaints, giving rise to the present Revision Petitions. They, however, state that the travel and allied expenses have not been received by any one of the Complainants. In view of the above, we dispose of the Revision Petitions on consent, with a direction that the Complainants shall be entitled to the refund of the total amounts deposited by them with the Petitioners along with interest @ 12% p.a. from the date of each deposit along with the costs of ₹10,000/- in each of the cases. It is stated by learned Counsel appearing for the Petitioners that the entire amounts received from the Complainants along with interest @ 12% p.a. have already been deposited and a sum of ₹1,00,000/- has already been released to each of the Complainants. If that be so, the balance amount still lying deposited in this Commission shall be released to the Complainants forthwith. The deficiency in the amounts, payable to the Complainants in terms of this order, shall be -4- made good within three weeks from today, which shall be directly remitted by means of Demand Draft/Bankers’ Cheque by the Petitioners to the Complainants along with the travel and allied expenses of ₹10,000/- in each of the cases. Both the Revision Petitions stand disposed of in the above terms with no order as to costs. |
