Shri S.L.Behera, President : - The complainant case in brief is that he is the registered owner of one Praise vehicle (Electric, BOV)Motor Cycle bearing Regn. No. OD-08J-5235. He has purchased the said vehicle on dtd. 06.07.2018 by paying Rs.66,676/- only from a dealer from Bhawanipatna, Kalahandi and registered at RTO, Kalahandi (Odisha). From dt.30.04.2019 the said vehicle started problem which the complainant deposited the vehicle before the O.P.No.2 who is the authorized service centre and Show Room of the vehicle. The O.P.No.2 changed the battery of the vehicle and taken Rs.11,000/- only from the complainant but after few days the vehicle started the same problem as earlier. The complainant requested the O.Ps to solve his problem but the O.Ps./ did not take any response, hence this case.
On receiving notice the O.Ps. kept silent even after providing opportunities and stand ex-parte ultimately.
Heard from the complainant. The complainant purchased an electric motor bike on dt.06.07.2018 by paying Rs.66,676/- only from Bhawanipatna, Kalahandi (Odisha) and got registered at Kalahandi but residing in Jharsuguda. After few months i.e within the warranty period since dt.30.04.2019 the said vehicle started problems. The complainant rushed before his nearest authorized show room i.e. O.P.No.2 where O.P.No.2 taken Rs.11,000/- within in warranty period and replaced a new battery but after few days the same problem occurred again. The O.P.No.2 issued a “Warranty of Battery Certificate” on dtd.07.05.2019 of 09 months period but within few days the vehicle continued its problem. The complainant approach several times to O.Ps but the O.P No.2 did not responded in this regard which shows gross negligence on the part of O.P.No.2. The O.Ps kept silent in this case even after providing sufficient opportunities which shows that they have nothing to say in this case.
In the above facts and circumstances the complaint petition is hereby allowed by directing the O.P.No.2 to replace a new defect free battery to the complainant and pay a sum of Rs.11,000/-(Rupees eleven thousand) only towards harassment, mental agony including cost of the case within 30(thirty) days of receipt of this order, failing which the O.P shall pay interest @ 10% per annum on the above mentioned awarded amount till realization.
Accordingly the case is disposed of.
Order pronounced in the open court today the 25th day of September’ 2019 and copy of this order shall be supplied to the parties as per rule.
