          Ld. counsel for opposite party No. 1-Insurance company has stated at bar that opposite party No. 1 has filed an application for disposal of the complaint as pre-mature as the opposite party No. 1-Insurance company has not repudiated the claim of the complainant so far. Thereafter, ld. counsel for opposite party No. 1-Insurance company also made statement in the Forum that opposite party No.1-Insurance company would decide the claim of the complainant within one month from the date of receipt of copy of order. Thereafter, attorney of the complainant made statement that in view of the statement of ld. counsel of opposite party No. 1-Insurance company, he does not want to proceed further with the instant complaint at this stage and same may please be disposed off in accordance with the statement of ld. counsel for opposite party No. 1 -Insurance company, but the right of the complainant may be reserved to file fresh complaint if the complainant is not satisfied with the decision of opposite party No. 1-Insurance company 1. In view of it, the complaint is disposed off with the observation that opposite party No. 1-Insurance company shall decide the claim of the complainant within one month from the date of receipt of copy of the order though the complainant is also permitted to file fresh complaint in case the complainant is not satisfied with the decision of the opposite party No. 1-Insurance company. However, it is made clear that if the opposite party No. 1- Insurance Company failed to decide the claim of the complainant within the above said one month then the claim of the complainant shall be deemed to have been allowed by opposite party No. 1- Insurance Company in toto. Keeping in view the peculiar circumstances of the case, the parties are left to bear their own costs. Copy of order be supplied to the parties immediately, free of costs, under the law. File be consigned to record room.
