Complainant Dilip Sarkar is present. Sri Alendranath Roy, authorised person of the O.P. Superintendant of Post Office is present. He files letter of Authority of the O.P. and some documents i.e a receipt dt.29/01/0215 signed by the complainant and two witnessess and copy of ledger of A/C no.181416. He also files a petition for disposal of this case stating that the grievance of the complainant has been settled by giving him the updated passbook with interest for 2013-2014. Petition is shown to the complainant who puts signature on the petition.

Heard submission of Sri. Alendranath Roy, authorised person of the O.P. Superintendant of Post Office and the submission of the complainant in person. Sri.Alendranath Roy prays for disposal of this case as O.P. has fulfilled the grievance of the complainant. The complainant admits that the O.P. has given him new updated pass book with interest and he prays for compensation and litigation cost. Seen and perused the petition of complaint, the new passbook given to the complainant (original passbook returned back to the complainant after replacing xerox copy of the same) and the copy of the ledger filed today by the O.P. We find that the main grievance of the complainant was that he was  not getting passbook of his A/C no.181416 and misappropriation of money from his said A/C which according to him should be Rs.3300/- as balance after his withdrawal of Rs.5500/- on 08/11/2008. Admittedly the O.P. has given updated passbook with interest upto 2013-14 to the complainant on 29/01/2015 i.e. immediately after receiving notice of this case showing balance of Rs.8046.05 on 01/04/2014 with interest upto 2013-2014, and the complainant has withdrawn Rs.3046/- from his said A/C on 30/01/2015 after receiving the passbook from the O.P. So it can be said that the claim of the complainant has been fully and finally settled  by the O.P. within very short period of time and as the complainant has filed this case without any fees as he belongs to BPL category,  and he himself conducted this case, so in our considered opinion  the complainant is not entitled to compensation and the cost of the proceeding. In such circumstances  in our considered opinion, the case should not be dragged further and the case should be disposed of. This case stands disposed of accordingly without cost.

                            Let copy of this final order be supplied to the parties free of cost forthwith in terms of Sec.5(10) of West Bengal Consumer Protection Act 1987.
