            The case of the complainant is that he applied for a telephone connection on 27.1.2006 and paid an amount of Rs.2999/-.  After getting connection he used the telephone for four months, later faulty.  On receipt of the complaint, opposite party fixed an antenna.  Again it became faulty.  Complainant used to pay the bill every month.  Since there is deficiency of service on the part of the opposite party, complainant prays for the return of the paid amount of Rs.2999/- along with a compensation of Rs.10,000/-.

 

            Even though repeated notices were sent, opposite parties 1 and 3 not appeared before this Forum.  Opposite party No.2 appeared and filed version.  During the time of examination, complainant exonerated opposite party No.2 and claimed no relief from opposite party No.2 by stating that he is not working for the company at present.  Now the only question remains is who is liable for the deficiency of the service to the complainant. 

 

            Complainant was examined as PW1 and Exts. A1 and A2 were marked.

 

            It clearly established the relationship with opposite party No.1 and they are liable to render the service to the complainant.  After   receiving the payment from the complainant latches of the opposite party in providing proper service is a deficiency of service and hence opposite party No.1 is liable to compensate to complainant.

 

            Hence this Forum directs the opposite party No.1 to return the amount of Rs.2999/- along with a compensation of Rs.1500/- to the complainant with no cost.  Comply the order within one month after receipt of the copy of this order.

 

            Pronounced in open Court this the 27th  day of February 2009.
