Sh. Girish Chandra Gandhi - appellant in person as well as learned counsel for respondent has appeared.
The appellant has stated that he has received the entire amount in compliance of the terms and condition of the compromise and the appellant has put a note in the side of the order sheet accordingly. The appellant has also submitted a payment receipt alongwith paper Nos. 95 to 99.
The above-said papers have clearly depicted that the appellant has received the decretal amount from the District Commission concerned.
A perusal of the order sheet has also shown that apart from decretal amount, the appellant has received an amount of Rs. 45,000/- (Rs. Forty Five Thousand only) in terms of compromise.
Both the parties have already filed the compromise (paper No. 87) which is accepted and endorsed by both the parties and it has already been verified and accepted by this Commission.
As the compromise has already been accepted, hence the appeal is decided in terms of compromise and the above compromise shall form part of the decree. No order as to costs of the appeal.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith compromise and original record be sent to the District Commission concerned for perusal and necessary information.
