By Smt. Padmini Sudheesh, President: The complainant’s case is as follows: The complainant-1 to 5 are the passengers in bus named Kayyalas No.KL-8T-5451. The complainants-1 to 4 used to travel twice daily from Thriprayar to Thalikulam beach stop and vice versa. The 5th complainant used to travel from Thriprayar to Thalikulam beach and from Thalikulam beach to Thriprayar centre for 3 days in a week. The respondents-1 and 2 is receiving Rs.4/- as charges from Thriprayar stand to Thalikulam. The distance between these places is only 4.5 kms. The KSRTC buses are now charging only Rs.3.50 for the journey from Thalikulam beach stop via Thalikulam centre to Thriprayar. The distance covered by this is 5.5 kms. So it is very clear that the respondents-1 and 2 are taking more charges other than the fixed fare stage. The respondents are not giving tickets for the charges and if it is asked they used to scold the passengers. The complainants are not having any other dev ice for their journey through this route. On 27.7.06 the 5th complainant applied for the copy of the fare stage given to the said vehicle given by respondents-3 to 6 through the Right of Information Act. But the 3rd respondent never given such a copy. The complainants-1 to 5 had given a complaint to S.I. of Valappad and no justice showed by him. Subsequently the 5th complainant had given application dated 27.7.06 through Right of Information Act but no information is received so far upon this. Hence the complaint. 2. The respondents are called absent and set exparte. 3. To prove the case of the complainants they filed affidavit and the documents produced by them are marked as Exts. P1 to P6. 4. According to the complainants they are the usual passengers in the respondent’s bus and the 2nd respondent who is the bus conductor of the respondent’s bus is receiving bus fare more than the fare stage. The complainants state that the KSRTC bus is charging less bus fare. The respondents-3 to 6 showed reluctance for issuing copy of the fare stage schedule given to the respondent bus. The first respondent is usually not giving tickets for the bus fare. 5. There is no counter evidence to the evidence of complainants. 6. In the result, the complaint is partly allowed and the respondents-1 and 2 are directed to return Rs.5760/- (Rupees five thousand seven hundred and sixty only) the excess amount received and pay Rs.2500/- (Rupees two thousand and five hundred only) as compensation with cost Rs.500/- to the complainants within a month.
