The facts of the case in brief is that the complainant has alleged that Oriental Bank of Commerce (OBC), Gandhi Nagar Branch, Delhi (OP) has withdrawn a sum of Rs. 4,000/- from her account without any explanation.
The complainant alleges that on 20.03.208, when she went to the OP bank for getting her pass book updated, she found a discrepancy in the bank account.
The case of the complainant is that as per the pass book entry (Annex. ‘A’ at page no. 9 of the paper book), the balance as on 06.03.2018 was Rs. 76,434/-. The next entry in the pass book indicates that as on 20.03.2018 at 12.06 p.m., the balance was Rs. 72,434/-. The complainant states that the bank could not explain the difference of Rs. 4,000/- in these two entries.
When we enquired from the complainant about the communication with the bank, the complainant states that she made oral complaint to the bank and there was no written complaint made to the bank. However, a police complaint to this effect was lodged on 27.03.2018 in police station Gandhi Nagar. The police complaint is at page no. 12 of the complaint.
We have seen all the documents carefully and we have found that there is no communication made to the bank regarding any fraudulent activity in her account. Further, we also see from the pass book which was annexed by the complainant herein that there is a cash withdrawal of Rs. 4,000/- on 20.03.018 which is indicated in the pass book just below the entry of Rs. 72,434/-. After a cash withdrawal, the balance indicated in the pass book is also Rs. 72,434/-. It appears that the entry indicated available balance on 20.03.2018 which was supposed to be printed just blow the cash withdrawal was printed in the pass book above the said withdrawal. The pass book annexed with the police complaint also indicates the same position as the entry on 06.03.2018 indicates that the balance on the said date was Rs. 76,434/-, but the next entry indicates that on 20.03.2018, there was a cash withdrawal of Rs. 4,000/- and after that the balance is Rs. 72,434/-.
On the face of the record, we do not see any deficiency in service. Hence, this complaint is dismissed. No order as to cost.
