F I N A L O R D E R
- This is an application U/S 12 of the C.P. Act, 1986 filed by the petitioner, Smt. Soma Dasgupta, praying for direction upon the o.ps., to pay redemption amount of Rs. 7,920/- and compensation of Rs. 50,000/- for, mental and financial harassment.
- The case of the petitioner is that she purchased solar energy product from the o.p. no. 1 who is a registered company under Company Act on 10.10.2012 being policy no. 850688 on payment of Rs. 600/- and he was informed that the redemption amount would be of Rs. 7,920/-. being the product value. On maturity the o.ps. did not pay the same and so the petitioner field this case.
- The o.ps. though served with notice did not appear in the case and thus the case is heard ex parte against them.
4. The only point to be decided herein whether the petitioner is entitled to get reliefs as prayed for ?

In support of her case the petitioner filed affidavit as well as documents wherefrom it is noticed that she made payment for product value of Rs. 7,920/- to the o.ps. on 10.10.2012 and was issued with this receipt wherefrom it could be noticed that the date of maturity was 10.10.2013. But receiving no payment the petitioner filed this case wherein oral as well as documentary evidences went unchallenged and there is nothing to disbelieve the case of the petitioner who is entitled to the relief as prayed for.
In the result, the case succeeds.
Court fee paid is correct.
Hence,
O R D E R E D
That the C. C. Case No. 612 of 2014 ( HDF 612 of 2014 ) be and the same is allowed ex parte against the O.Ps. without costs.
The petitioner is entitled to the sum of 7,920/- with 9% interest till realization from the date of maturity i.e., 10.10.2013. She is also entitled to compensation for a sum of Rs. 10,000/- for mental and physical harassment. The o.ps. are directed to pay the above sum to the petitioner within 30 days from the date of this order failing the petitioner is to put the final order in execution.
No order as to costs.
Supply the copies of the order to the parties, as per rule.
