F I N A L O R D E R - This is an application U/S 12 of the C.P. Act, 1986 filed by the petitioner, Diptendu Boral, praying for compensation for a sum of Rs. 50,000/- from the o.ps., NVD Solar Ltd. and four others and direct the o.ps. to pay M.S.I. amount of Rs. 500/- per month from July, 2014 to till the date of filing amounting to Rs. 2,500/- with interest and cost.
- The case of the petitioner is that he applied for NVD Solar Power Scheme in the form of ‘Bond’ and deposited a sum of Rs. 50,000/- at theo.p. no. 1, NVD Solar Ltd. for a period of 36 months w.e.f. 30.7.2012and the scheme would end on 30.7.2015 and underterms and conditions that the o.p. 1 company would pay Rs. 500/- p.m. as M.I.S. and on maturity after three years the total redemption amount would be Rs. 51,500/-. He was supplied with a purchase certificate but the o.p. though paid the MSI amount till June, 2014 yet stopped payment since then and after several requests of the petitioner went on giving false assurance and thus the o.ps. harassed the petitioner. Finding no other alternative the petitioner filed this case.
- The o.ps. though appeared in the case did not file any written version and thus the case is heard ex parte against them.
DECISION WITH REASONS : 4. In support of his case the petitioner filed affidavit as well as documents being certificate under NVD Solar Gift Scheme and also document showing his deposit of Rs. 50,000/- and receiving the MIS amount of Rs. 500/- per month since August, 2012 to June, 2014 and all these documents along with the affidavit proved the case of the petitioner ex parte as all these oral and documentary evidence went unchallenged and there is nothing to disbelieve the case of the petitioner. This is a clear case of deficiency in service on the part of the o.ps. who failed to comply the terms and conditions as mentioned in the certificate as well as in the bond document. In the result, the claim case succeeds. Court fee paid is correct. Hence, O R D E R E D That the C. C. Case No. 656 of 2014 ( HDF 656 of 2014) be allowed ex parte with costs against the O.Ps. The petitioner is entitled to the compensation amount of Rs. 50,000/- and also the amount as mentioned in the MSI Scheme till the date of maturity and a litigation costs of Rs. 5,000/- and the o.ps. are directed to pay the above sum as per terms of the bond within 30 days from the date of this order failing the complainant is at liberty to put the final order into execution after expiry of the stipulated period and interest @ 9% would accrue on the above sum till recovery.
