ORDER

By Smt. Padmini Sudheesh, President: The petitioner’s case is as follows:- 1. Respondents-2 to 7 are the partners of first respondent. The petitioner had deposited Rs.40,000/- in the first respondent firm only upon the promise given by the respondents that higher interest will be availed. A receipt was issued and assured that the amount will be returned with interest at the rate of 12% per year on 23.5.02. After attaining the maturity date she has demanded the amount, but the respondents wanted to renew the receipt and she has renewed it. After that period petitioner has demanded the amount, but not returned. After 23.6.05 no interest also received. Letter sent, no reply, no remedy. Hence this complaint. 2. Respondents were set exparte. 3. To prove the case, the petitioner has produced three documents, which are marked as Exts. P1 to P3. 4. According to the petitioner, she is entitled to get the Fixed Deposit receipt amount with 12% interest from 23.6.05 and compensation and costs. There is no counter evidence. 5. In the result, the complaint is allowed and the respondents are directed to return the Fixed Deposit amount of Rs.40,000/- (Rupees forty thousand only) with interest at the rate of 12% per annum from 23.6.05 till realisation and Rs.1000/- (Rupees one thousand only) as costs to the petitioner. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 30th day of May 2008.
