O R D E R

Per Sri A. Hazarath Rao, President:-

        Complainant and 4^th opposite party present.  The complainant filed memo as detailed infra:

        “It is submitted that in the above matter the 4^th opposite party gave new mobile phone bearing model No.Nokia 500 (Duel Sim IMEI No.358355059727640 to the complainant in order to settle the matter.  Hence, the Hon’ble Forum may be pleased to close the complaint as settled out of Court”.

        The complainant handedover the defective mobile to 4^th opposite party filed joint memo to the following effect:

        “It is humbly submitted that as per the settlement, the complainant handed over the Nokia mobile with model No.X2 in replace of Nokia Asha 500 to the 4^th opposite party today and received by the 4^th opposite party.  Hence this memo”

        In addition to it, the complainant endorsed on the complaint as ‘settled out of Court with replacement of new piece’.

        In view of those two memos and the above endorsement made by the complainant, the complaint is dismissed as settled.
