The complainant was a student in the Pace I.T Solutions Computer firm, Rajakumari. The complainant joined the P.G.D.C.A one year course. She had remitted Rs.250/- by way of admission fees on 27.03.2006 and Rs.8,000/- by way of fees was agreed to be paid in 10 instalments. The first instalment of fees was paid on 15.04.2006. The opposite party was agreed to complete the PGDCA course within one year. But out of the 8 subjects opposite party was completed only 3 subjects. The complainant approached the opposite party in several times and enquired about the matter, no satisfactory explanation was given to her. Though she demanded back the money paid by her towards the fees and other expenses. But no reply was given by the opposite party. Alleging deficiency in service against the opposite party, the complaint has been filed for a direction to the opposite party to refund the fees collected and also to pay compensation.
2, The opposite party is exparte. The complainant has given evidence as PW1 and Exts.P1 to P5 were marked.
3. The POINT :- Exts.P1 and P2 (series) are the fees receipts. Ext.P3 is a copy of the legal notice sent by the complainant to the opposite party, but the opposite party did not give any reply to the complainant. The complainant has lost an year. The complainant was examined as PW1 and her evidence would show that there was clear deficiency in service on the part of the opposite party. Therefore the opposite party is bound to refund Rs.8,250/- paid by the complainant by way of fees and the complainant is also entitled to the cost of this petition and expenses for bus fair, when she was studying which we would limit to Rs.2,500/-.
In the result, the opposite party is directed to pay to the complainant Rs.8,250/- (Rupees Eight Thousand Two Hundred and Fifty only)along with Rs.2,500/-(Rupees Two Thousand and Five Hundred only) as compensation to the complainant within 30 days, failing which the outstanding amount shall carry further interest at 12% per annum from the date of default.
