  The complaint was filed by the complainant under section 35 of the Consumer Protection Act 2019 alleging deficiency in service against the opposite parties in not processing the insurance claim of the complainant along with a prayer to direct the opposite parties to pay a sum of Rs.5,00,000/- towards compensation for the mental agony and hardship caused to the complainant along with cost of the proceedings.
 No representation for complainant.  Opposite parties present.  Inspite of several opportunities given to the complainant proof affidavit was not filed. Continuously no representation for complainant on 08.05.2023, 15.05.2023, 25.05.2023, 13.06.2023, 20.06.2023, 30.06.2023 and on 10.07.2023.  Thus, Inspite of several opportunities, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file.  Hence the consumer complaint is dismissed for non prosecution.  No cost.
This order was pronounced by us in the open Commission on this 10th July 2023.
